Executive Summary

U.S. Court of Appeals for Federal Circuit denies the appeal of Evident Corporation and Peroxydent Group on Feb. 22 in the patent infringement lawsuit filed against Colgate and Church & Dwight in June 1997. The previous ruling stated Evident's U.S. Patent No. 4,971,782 involving the production of baking soda and peroxide toothpaste was unenforceable. The New Jersey District Court ruled against Peroxydent, contending that Evident had sufficient standing to bring the original lawsuit against C&D and Colgate. The Court also affirmed its original judgment that the case was exceptional and the resulting legal payouts from Evident and Peroxydent to C&D were reasonable...
