Executive Summary

Plaintiff reports an out-of-court settlement of suit seeking to bar Perfumay from using its service mark and advertising slogan because of Perfumania's claim that they were too similar to its service mark and slogan. The lawsuit was filed Aug. 6, 1993, and Perfumania was denied a preliminary injunction against Perfumay in October 1993 ("The Rose Sheet" Oct. 25, 1993, In Brief). During the course of the case, two of the three defendants filed for bankruptcy, and by the time of the final settlement, only one Perfumay store was operational, Perfumania said
