It was clear that at the end of the 90 minutes of lively and fast-moving oral arguments before the US Supreme Court on 25 March the decision likely will come down to the often tie-breaker Justice Anthony Kennedy in another challenge against the Affordable Care Act (ACA), in which two for-profit corporations are insisting they have the right to exclude certain forms of contraceptives in their employer-sponsored health plans based on the business owners' religious objections.
