India’s Commerce Ministry Moves To Block Generic Approval Proposal

This article was originally published in PharmAsia News

Executive Summary

One Indian Cabinet office has intervened to block a proposal by the country's drug authority to withhold market approval for generics of patented drugs. The commerce ministry moved to block the proposal on grounds the patent agency should not be involved in the drug-approval process. The Drug Controller General of India had proposed to involve the patent office in the denial effort. The commerce ministry says approvals should be based on whether a drug should be approved for the market and that the issue of a patent should not be a criterion in that decision.
